The data collected in connection with the order is processed for the purpose of performing the contract concluded by placing the order (Article 6(1)(b) of the GDPR), issuing an invoice (Article 6(1)(c) of the GDPR, in conjunction with regulations governing invoicing), taking the invoice into account in the accounting documentation and fulfilling other tax and accounting obligations (Article 6(1)(c) of the GDPR in conjunction with regulations governing tax and accounting obligations), and for archival purposes, for potential defense, identification, or claims settlement needs, as well as to identify a returning customer, which constitutes our legitimate interest (Article 6(1)(f) of the GDPR).

Order data will be processed for as long as necessary to fulfill the order, and then until the statute of limitations for claims arising from the contract expires. In addition, after this period, we may continue to process data for archival purposes, for potential defense, identification, or claims settlement needs, as well as to identify a returning customer. As for processing information that does not come from you, but has been collected automatically by our mailing system, we rely on our legitimate interest (Article 6(1)(f) of the GDPR) consisting of analyzing the behavior of newsletter subscribers to optimize mailing activities.

You can unsubscribe from the newsletter at any time by clicking on the dedicated link in each message sent as part of the newsletter or simply by contacting us. The legal basis for processing after the end of contact is also our legitimate interest in the form of archiving the correspondence to ensure that we can demonstrate certain facts in the future (Article 6(1)(f) of the GDPR).

The content of correspondence may be subject to archiving, and we are unable to determine exactly when it will be deleted. You have the right to request a presentation of the correspondence history you have had with us (if it has been archived), as well as to demand its deletion, unless archiving is justified by our overriding interests, such as defense against potential claims from your side.

Tax and accounting obligations – details

If we issue an invoice on your behalf, it becomes part of our accounting documentation, which will be stored for the period required by law. Your personal data is processed in this case for the purpose of fulfilling our tax and accounting obligations (Article 6(1)(c) of the GDPR in connection with provisions regulating tax and accounting obligations).

Archive – details

As part of the description of individual purposes of personal data processing listed above, we have indicated the periods for which personal data will be stored. Analysis, statistics, optimization – details

We collect statistical information about user behavior while browsing our websites, such as clicks on links, transitions between subpages, time spent on individual pages, etc. We analyze this information in order to optimize our pages for user experience, effectiveness, and conversion. # 7: For how long will we keep your personal data?

The data retention periods have been indicated separately for each processing purpose. You can find this information within the details dedicated to each specific processing purpose.

# 8: Who are the recipients of your personal data?

We can assume that modern business cannot function without third-party services. We also use such services, some of which involve processing your personal data. External service providers who participate in the processing of your personal data include:

  • A hosting provider that stores data on the server,
  • A cloud computing service provider where backup copies containing your personal data may be stored,
  • A mailing system provider where your data is stored if you are a newsletter subscriber,
  • A CRM system provider where we store your data to streamline the customer service process and for archival purposes,
  • An invoicing system provider where your data is stored for invoicing purposes,
  • An accounting office that processes your data visible on invoices,
  • Courier companies that process your data to the extent necessary to deliver your order,
  • A law firm that gains access to data if necessary to provide legal assistance on our behalf,
  • A technical support service provider that gains access to data if technical work is being conducted in areas where personal data is located,
  • Other subcontractors who gain access to data if their activities require such access.

Your personal data may also be transferred to tax authorities to the extent necessary to perform tax, settlement, and accounting obligations. This applies in particular to all declarations, reports, financial statements, and other accounting documents containing your personal data.

In addition, if necessary, your personal data may be disclosed to entities, authorities, or institutions authorized to access data under applicable law, such as police services, security services, courts, and prosecutor’s offices.

Furthermore, we use tools that collect a range of information about you related to your use of our website, including:

  • Information about the operating system and internet browser you are using,
  • Visited pages,
  • Time spent on the site,
  • Transitions between individual subpages,
  • Clicks on specific links,
  • The source from which you came to our site,
  • Age range and gender,
  • Your approximate location limited to the town/city,
  • Your interests, which are determined based on your online activity.

In our opinion, this information in itself does not constitute personal data. As these data are collected by external tools that we use, they are also processed by tool providers in accordance with their terms and privacy policies. In general, this information is used to provide and improve services, manage them, develop new services, measure the effectiveness of advertisements, protect against fraud and abuse, and personalize content and advertising.

Yes, some of the processing operations of your personal data may involve transferring them to third countries.

We transfer your personal data to third countries in connection with the use of tools that store personal data on servers located in third countries, particularly in the USA. The providers of these tools guarantee an adequate level of protection of personal data through appropriate compliance mechanisms provided by the GDPR, particularly by using standard contractual clauses.

The following tools are used for storing personal data on servers located in third countries:

  • Google services as part of the G-Suite package, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland – for all data processed within Google services, including data contained in files subject to synchronization with Google Drive.

We also remind you that we use external tools that may collect anonymous information about you. We have already mentioned this several times in this policy, including in response to the previous question. Providers of these tools often use servers located around the world, particularly in the United States of America (USA), to store the collected information.

We do not make decisions based solely on automated processing, including profiling, that would have legal effects on you or significantly affect you in a similar manner.

However, we do use tools that can take certain actions based on information collected through tracking mechanisms, but we believe that these actions do not have a significant impact on you because they do not differentiate your situation as a customer or affect the terms of any agreement you may have with us.

We emphasize that within the tools we use, we do not have access to information that would allow us to identify you. The information we are referring to here includes, in particular:

  • information about the operating system and internet browser you use,
  • third-party pages you visit,
  • time spent on the page,
  • transitions between individual subpages,
  • the source from which you come to our website,
  • age range you fall into,
  • your gender,
  • your approximate location limited to the city,
  • your interests determined based on online activity

The above information is not compared with your personal data stored in our databases. This information is anonymous and does not allow us to identify you. This information is stored on the servers of individual tool providers, which can often be located anywhere in the world.

The GDPR grants you the following potential rights related to the processing of your personal data:

  • the right to access your data and obtain a copy of it,
  • the right to rectify (correct) your data,
  • the right to erasure (if you believe that we are processing your data without a legal basis, you may request that we delete it),
  • the right to restrict processing (you may request that we limit the processing of your data to storage, or agreed-upon actions, if you believe that we have incorrect data or are processing it unlawfully),
  • the right to object to the processing of your personal data (you have the right to object to processing based on legitimate interests; you should specify a particular situation that justifies us ceasing processing; we will stop processing your data for these purposes unless we demonstrate that the grounds for processing your data override your rights or that your data is necessary for establishing, pursuing or defending legal claims),
  • the right to data portability (you have the right to receive your personal data, which you have provided us on the basis of a contract or your consent, in a structured, commonly used and machine-readable format; you may instruct us to transfer this data directly to another controller),
  • the right to withdraw consent for the processing of personal data, if you previously gave such consent,
  • the right to lodge a complaint with the supervisory authority (if you believe that we are processing your data unlawfully, you may file a complaint with the President of the Office for Personal Data Protection or another competent supervisory authority).

The rules related to the exercise of the above-mentioned rights have been described in detail in Articles 16-21 of the GDPR. We encourage you to familiarize yourself with these provisions. We would like to emphasize that the aforementioned rights are not absolute and will not apply to all processing activities related to your personal data.

We would like to point out that one of the aforementioned rights is always available to you – if you believe that we have violated the provisions on personal data protection while processing your personal data, you have the right to lodge a complaint with the supervisory authority (the President of the Office for Personal Data Protection).

You can also always ask us to provide you with information about what data we have about you and for what purposes we process it. Simply send a message to the email address at hey@designzima.com. However, we have made every effort to present the information you are interested in exhaustively in this privacy policy. You may also use the email address above to ask any questions related to the processing of your personal data.

We use the Google Analytics tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We implement this tool based on our legitimate interest, which consists of creating statistics and analyzing them to optimize our websites.

To use Google Analytics, we have implemented a special tracking code in the code of our website. The tracking code uses Google LLC’s cookies related to the Google Analytics service. You can block the Google Analytics tracking code at any time by installing the browser add-on provided by Google: https://tools.google.com/dlpage/gaoptout

Google Analytics automatically collects information about your use of our website. The information collected in this way is usually transmitted to Google’s servers, which may be located around the world and stored there. Due to the IP address anonymization we have activated, your IP address is shortened before being transmitted. Only in exceptional cases is the full IP address transmitted to Google’s servers and shortened there. The anonymized IP address transmitted by your browser as part of Google Analytics is not generally combined with other Google data.

Google Tag Manager – details

We use the Google Tag Manager tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, which allows us to manage tags, i.e., small pieces of code that enable us to control user traffic and behavior, collect information on advertising effectiveness, and take actions to improve our website. Google Tag Manager does not collect any information that could be used to identify you, but it triggers the activation of other tags that may collect data.

Google AdWords – details

We use remarketing features available within the Google AdWords system provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We carry out these activities based on our legitimate interest, which consists of promoting our own products or services through marketing.

During your visit to our website, a Google remarketing cookie is automatically left on your device, which collects information about your activity on our website. By gathering this information, we are able to display advertisements to you through the Google network based on your behavior on our website. For example, if you view a product, this information will be recorded by the remarketing cookie, which allows us to direct advertisements to you related to that product or any other that we deem appropriate. This advertisement will be displayed to you through the Google network while you browse the Internet and visit other websites.

We emphasize that we do not collect any data that would allow for your identification while using Google Ads. Any combination of data that would make it personal can only be made by Google, but we do not take responsibility for this because Google undertakes these activities based on the agreement made with you as a user of Google services.

By using Google AdWords, we are only able to define audience groups that we would like our advertisements to reach. Based on this information, Google decides when and how to present our advertisement to you.

Further processing of information only occurs if you have given consent to Google for the linking of your browsing history with your Google account and for the use of your Google account information to personalize the advertisements displayed on websites. In such a case, Google will use your data to create and define target groups for remarketing purposes on different devices. Google temporarily combines the information collected with other data to create target groups.

If you do not want to receive personalized advertisements, you can manage your advertisement settings directly through Google: https://adssettings.google.com/

We display advertisements on our websites as part of the Google AdSense network operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We undertake these actions based on our legitimate interest in monetizing the content we publish.

Our website, in connection with displaying AdSense ads, contains advertising tags that instruct your web browser to request advertising content from Google servers. Along with the advertising content, the server also sends a cookie file. Cookies are used to display ads based on your previous visits to our website or other websites. AdSense also uses cookies to improve ad quality, such as targeting ads based on topics that interest you, improving campaign effectiveness reports, and excluding ads you have already seen.

We emphasize that when we use Google AdSense, we do not collect any data that would allow for your identification. Any aggregation of data in a way that would make them personal data may be carried out by Google, but we are not responsible for this because Google carries out these activities based on an agreement with you as a user of Google services.

Further processing of information only occurs when you have given Google your consent to link browsing history with your Google account and use information from your Google account to personalize ads displayed on websites. In this situation, Google will use your data to create and define target groups for remarketing purposes on different devices. To do so, Google temporarily combines the collected information with other data it possesses to create target groups.

If you do not want to receive personalized advertisements, you can manage your advertisement settings directly through Google: https://adssettings.google.com/
